IU football’s Stephen Daley and Kellan Wyatt, basketball’s Sam Alexis and dozens of other class of 2022 athletes remain eligible after a Monday development in an Indiana court.
Judge Kara Krothe determined the NCAA is not likely to win on appeal and denied the organization’s request for emergency stay of the preliminary injunction granted in a Monroe County Court.
The NCAA has successfully obtained stays of injunctions in some instances, but Krothe ruled the NCAA has not shown it will suffer irreparable harm if the preliminary injunction stands.
Daley, Wyatt, Alexis and their fellow plaintiffs have sued the NCAA after the organization did not include class of 2022 athletes in its new five-year eligibility rule. They were granted a preliminary injunction to compete during the 2026-27 athletic year until their case could be heard.
One of the NCAA’s core arguments has been allowing class of 2022 athletes to play a fifth season will take roster spots away from other athletes. But Krothe says the NCAA has created that very same issue in 2027-28 with its new 5-year eligibility rule.
“The NCAA’s argument also ignores the roster crunch it created for the 2027-28 academic year by granting all athletes currently in school (other than those who redshirted) another season of competition,” Krothe wrote in her ruling.
The NCAA has appealed the injunction, and it has also filed an emergency motion to stay the injunction with the appellate court. A stay would deem Daley, Wyatt and Alexis ineligible until the appeal is heard. The student-athletes have until Oct. 8 to respond to that emergency motion.
It is not clear how soon any ruling will come out of the appeals court.
